Terms of Service
These Terms of Service ("Terms") govern your use of Safari Itinerary ("the Service"), operated by Safari Itinerary ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Description of Service
Safari Itinerary is a software-as-a-service platform that allows safari tour operators and travel agencies to create, manage, and share client itineraries. The Service includes an itinerary editor, media library, PDF export, and public itinerary sharing features.
2. Account Registration
To use the Service you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service.
3. Free Trial
New accounts receive a 30-day free trial with no credit card required. At the end of the trial period, your account will be placed on hold and no charges will be applied. Your data will be preserved. To continue using the Service, you must subscribe to a paid plan.
4. Subscriptions and Billing
Paid subscriptions are billed monthly. By subscribing, you authorise us to charge your payment method on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. All fees are non-refundable except where required by applicable law.
We reserve the right to modify pricing with 30 days' advance notice by email.
5. Acceptable Use
You agree not to use the Service to:
- Upload or share content that infringes any third-party intellectual property rights
- Transmit unlawful, defamatory, obscene, or fraudulent content
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Use the Service to send unsolicited commercial communications
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service
6. Intellectual Property
You retain all rights to the content you upload (itinerary data, images, text). You grant us a limited, non-exclusive licence to store and display your content solely for the purpose of providing the Service.
The Safari Itinerary platform, including its design, code, and trademarks, is our exclusive property. Nothing in these Terms transfers any ownership of platform IP to you.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Availability and Modifications
We aim for high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any feature with reasonable notice. We will never delete your data without prior notification.
9. Limitation of Liability
To the maximum extent permitted by law, Safari Itinerary shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of revenue or data. Our total liability to you in any month shall not exceed the fees paid by you in that month.
10. Termination
Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you breach these Terms. Upon termination, your right to use the Service ceases and we will retain your data for 90 days before permanent deletion.
11. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved by negotiation in good faith, failing which by the courts of competent jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email at least 14 days in advance. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
